By creating an account or using Athistry, you agree to these Terms and our Privacy Policy. If you do not agree, do not use the platform.

Athistry is for college athletes who are at least 18 years old. By using the platform, you confirm that you meet that requirement. Athistry does not operate a public searchable athlete directory. Profiles are intended to be viewed only through direct links shared by the athlete or through other permitted platform functionality. Scraping, harvesting, copying, indexing, or using athlete profile data for unauthorized commercial purposes is prohibited.

You are responsible for your account, your login credentials, and any activity that happens under your account. You agree to provide accurate and current information and to update it if it changes.

You keep ownership of the content you upload to Athistry, including photos, stats, bio information, and other profile materials. By uploading content, you give Athistry a non-exclusive, royalty-free license to host, store, display, reproduce, and use that content as needed to operate the platform, improve the platform, maintain security, and promote Athistry, so long as that use does not suggest your endorsement of a third-party product or service without your explicit consent. We will not sell or license your name, image, or likeness to third parties for commercial endorsement without your explicit consent. This license lasts only while your content remains on the platform, except where limited retention is reasonably necessary for backups, security, legal compliance, dispute resolution, or recordkeeping. You are responsible for making sure you have the right to upload your content and that it does not violate any law or any third-party rights.

You are responsible for making sure your use of Athistry and any deals, promotions, or relationships you pursue comply with all applicable rules and obligations, including school policies, conference rules, NIL rules, state laws, and advertising disclosure requirements. Athistry does not provide legal, tax, or compliance advice and does not guarantee that any opportunity or agreement is allowed under rules that apply to you.

Athistry may help facilitate introductions or inquiries between athletes and brands, but Athistry is not a broker, agent, manager, or party to any agreement between them. We do not guarantee brand deals, payments, responses, performance, or results. Any agreement between you and a brand or other third party is solely between those parties.

You agree not to provide false or misleading information, impersonate another person, use the platform for unlawful fraudulent or abusive purposes, scrape crawl harvest or copy platform or profile data, use bots or unauthorized automated tools, interfere with platform security or operations, or upload content that infringes another person's rights or violates the law.

Athistry owns the platform including its software branding design and related content except for content uploaded by users. You may use the platform only as permitted by these Terms.

If you believe content on Athistry infringes your rights or violates these Terms contact us at hello@athistry.com. We may investigate and remove content or suspend accounts at our discretion.

Athistry is currently free to use unless stated otherwise. We may introduce paid features in the future with advance notice.

We may suspend or terminate accounts that violate these Terms create risk for the platform or other users or involve misuse fraud or unlawful conduct. You may stop using Athistry at any time and may request account deletion by contacting hello@athistry.com.

Athistry is provided on an as is and as available basis. We do not guarantee that the platform will always be available secure or error-free or that any brand inquiry or user information will be accurate complete or reliable.

To the fullest extent allowed by law Athistry and its affiliates officers employees contractors and agents will not be liable for any indirect incidental special consequential or punitive damages or for any loss of profits revenue data goodwill or business opportunities arising from your use of the platform. Our total liability for any claim relating to Athistry will not exceed the greater of $100 USD or the amount you paid us in the 12 months before the claim arose.

You agree to defend indemnify and hold harmless Athistry and its affiliates officers employees contractors and agents from claims losses damages liabilities and expenses including reasonable attorneys fees arising out of your content your use of the platform your violation of these Terms your violation of any law rule or third-party right or any agreement or interaction between you and a brand or other third party.

These Terms are governed by the laws of the State of Texas without regard to conflict of law rules. Any dispute relating to these Terms or the platform must be brought in the state or federal courts located in Travis County Texas.

We may update these Terms from time to time. If we make material changes we will post the updated version and revise the Effective Date. Continued use of Athistry after the update means you accept the revised Terms.
